Welcome to BritPass: Life in the UK Test. These Terms of Service ("Terms") govern your use of our mobile application and website operated by Diffused Innovations Ltd. By accessing or using our Service, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using BritPass (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

BritPass provides educational content and practice materials to help users prepare for the Life in the UK test. Our services include:

• Mobile applications for iOS and Android

3. No Guarantee of Results

Our materials are designed to supplement your study efforts, not replace thorough preparation using the official handbook "Life in the United Kingdom: A Guide for New Residents".

4. User Accounts

If you create an account with us, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use

We reserve the right to terminate accounts that violate these Terms or engage in fraudulent or abusive behaviour.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt the Service
• Copy, distribute, or modify our content without permission
• Use automated tools to access the Service (bots, scrapers, etc.)
• Share your account with others or resell access
• Misrepresent your identity or affiliation

6. Intellectual Property

All content on BritPass, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of Diffused Innovations LTD or its licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Service without our prior written consent.

The Life in the UK test content is based on publicly available information from the UK Government. Crown copyright material is reproduced under the Open Government Licence v3.0.

7. Purchases, Subscriptions, and Payments

BritPass: Life in the UK Test offers premium features through one-time purchases and weekly subscription plans. All transactions are processed through the Apple App Store or Google Play Store.

7.1 Purchase Options

• One-Time Purchase: Unlock premium features with a single payment
• Weekly Subscription: Access premium features with automatic weekly renewal
• Free trial periods may be offered (terms displayed before purchase)

7.2 Payment Processing

• All payments are processed by Apple (for iOS) or Google (for Android)
• We do not collect, store, or have access to your payment information
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase
• You agree to pay the price displayed at the time of purchase
• All prices include applicable VAT/sales tax as required by law

7.3 Subscription Terms

For weekly subscription plans:

• Billing Cycle: You will be charged every 7 days
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscription Management: Manage or cancel your subscription in your device's account settings (Apple ID or Google Play)
• Cancellation: You can cancel at any time, but cancellation takes effect at the end of the current billing period
• No Partial Refunds: No refunds or credits are provided for partial periods

7.4 Free Trials

If you sign up for a free trial:

• You will have access to premium features for the trial period (duration displayed before signup)
• You must cancel before the trial ends to avoid being charged
• If you don't cancel, you will be automatically charged the subscription price when the trial ends
• Free trials are typically limited to one per user
• We reserve the right to determine trial eligibility

7.5 Refunds and Cancellations

• iOS (Apple): Request refunds through Apple at support.apple.com/billing
• Android (Google): Request refunds through Google at support.google.com/googleplay
• Refunds are subject to Apple's and Google's refund policies, not ours
• We cannot process refunds directly as we do not handle payments
• For billing questions, contact the app store where you made the purchase

7.6 Price Changes

• We reserve the right to change subscription prices at any time
• Price changes will not affect your current subscription period
• You will be notified of price changes before they take effect
• If you do not agree to a price increase, you may cancel your subscription

7.7 Access to Purchased Content

• One-time purchases provide permanent access to premium features (subject to app availability)
• Subscription features are available only while your subscription is active
• If you cancel a subscription, you retain access until the end of the paid period
• We may occasionally offer promotional pricing or discounts at our discretion

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIFFUSED INNOVATIONS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Failure to pass the Life in the UK test
• Service interruptions or errors
• Unauthorised access to your account

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Diffused Innovations LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Apple App Store Additional Terms

If you download the app from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Diffused Innovations Ltd, not Apple
• Apple has no obligation to provide maintenance or support for the app
• Apple is not responsible for addressing any claims relating to the app
• Apple is not responsible for any product liability claims
• Apple is not responsible for claims that the app fails to conform to legal requirements
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with applicable third-party terms when using the app
• You represent that you are not located in a country subject to US embargo or designated as a "terrorist supporting" country

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you.

12. Google Play Store Additional Terms

If you download the app from Google Play Store, you acknowledge and agree that:

• These Terms are between you and Diffused Innovations Ltd, not Google
• Google is not responsible for the app or its content
• Google has no obligation to provide maintenance or support
• To the maximum extent permitted by law, Google has no warranty obligations regarding the app
• You must comply with the Google Play Terms of Service

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except:

• If you are a consumer in the EU, you may also bring proceedings in your country of residence
• If you are a consumer in California, you have certain rights under California law

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

16. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Diffused Innovations Ltd regarding the use of the Service and supersede all prior agreements and understandings.
